Lebashe Investment Group (Pty) Ltd and its co-defendants welcome their comprehensive win at the Supreme Court of Appeal against General Bantu Holomisa and the United Democratic Movement.
In Bloemfontein yesterday, the five-Judge bench of the Supreme Court of Appeal heard arguments from both parties’ legal counsel and considered the aspects raised in relation to the interests of justice as well as the relevant sections of the Constitution.
After deliberations were had, the Supreme Court of Appeal found that the court order handed down by Honourable Judge Vivian Tlhapi in June 2018, granting an urgent interdict against General Holomisa and the UDM, was not appealable and as a result dismissed the appeal and granted the costs of two counsel.
Reacting to the news of their successful victory, Executive Director of Lebashe, Warren Wheatley said: “the decision of the Supreme Court of Appeal to dismiss the UDM and General Holomisa’s appeal vindicates our position against the defamatory and harmful allegations posed against us and our business…
In addition, Lebashe and its co-defendants will proceed with the defamation and damages action against the UDM as well as General Holomisa in his personal capacity due to the financial and reputational harm caused by their reckless, unsubstantiated and malicious allegations”.
